These Terms of Service (“Terms”) are a contract between you and Hapiga (“Tapely,” “we,” “us,” or “our”) and govern your use of the Tapely mobile application and related services (the “Service”).
By installing, opening, or using Tapely, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. Who can use Tapely
You may use Tapely only if you can legally form a contract in your country and your use is not prohibited by law. You must be at least 13 years old, or the minimum age required in your country.
If you use the Service on behalf of an organization, you confirm you have authority to bind that organization.
The Service is currently available on iOS.
2. Your account
When you first open Tapely, an anonymous account is created for your device. You may later sign in with a supported method.
You are responsible for all activity on your account, including uploaded content and purchases.

3. The Service
Tapely allows you to upload photos (and sometimes audio) to generate AI videos using third-party models (such as Replicate and fal.ai).
Your generated videos are stored so you can view, download, or share them.
We may modify or limit features, templates, or usage at any time.
4. Acceptable use
You agree not to use Tapely for illegal or harmful purposes, including:
- Illegal activities
- Any content involving minors in a sexual context (zero tolerance)
- Harassment, hate speech, threats
- Deepfakes intended to deceive or harm
- Impersonation
- Self-harm or harmful behavior promotion
- Terrorism or violent content
- Copyright or privacy violations
- Malware or system abuse
You also agree not to:
- Reverse engineer or extract source code
- Use bots or automation
- Resell or exploit the Service
- Bypass limits or restrictions
- Use the Service to build competing products
We may remove content or suspend accounts that violate these rules.
5. Your content
You retain ownership of all content you upload.
By using the Service, you grant Tapely permission to process and store your content and share it with AI providers only to operate the Service.
We do not sell your content or use it to train AI models.
You are responsible for ensuring you have rights and consent for any content you upload.
6. AI-generated outputs
You own the videos generated from your content, to the extent allowed by law.
However:
- Outputs may not be unique
- Outputs may contain errors or inaccuracies
- Outputs may resemble real people or copyrighted content
You are responsible for how you use generated content.
7. Subscriptions and billing
Tapely offers subscriptions and credit packs.
- Payments are processed through Apple (App Store)
- Subscriptions auto-renew unless canceled
- You can manage subscriptions in iOS settings
- Credits are non-refundable and may expire
- Refunds must be requested via Apple
8. Third-party services
Tapely relies on third-party providers such as Apple, Google Firebase, Replicate, fal.ai, and others.
We are not responsible for their actions or service disruptions.
9. Changes
We may update the Service or these Terms at any time. Continued use means you accept the changes.
10. Termination
You may stop using the Service anytime.
We may suspend or terminate access if you violate these Terms or if required by law.
11. Disclaimer
The Service is provided “as is” without warranties.
We do not guarantee it will be error-free or meet expectations.
12. Limitation of liability
Tapely is not liable for indirect or consequential damages.
Total liability is limited to the amount you paid in the last 12 months.
13. Indemnification
You agree to cover any claims arising from your use of the Service or your content.
14. Governing law
These Terms are governed by the laws of Vietnam.
15. Apple-specific terms
If you download via the App Store:
- Apple is not responsible for the Service
- Apple handles payments and refunds
- Apple may enforce these Terms as a third-party beneficiary
16. Miscellaneous
- These Terms and Privacy Policy form the full agreement
- Invalid sections do not affect the rest
- We may assign rights; you may not without permission
